These Terms of Use ("Terms") govern your access to and use of the website macrobian.science (the "Site") and your purchase of products and digital materials from Macrobian ("Macrobian," "we," "us," or "our"). By accessing the Site or making a purchase, you agree to these Terms. If you do not agree, do not use the Site.

1. Who may use the Site

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to purchase from us. By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

2. Our products

Cosmetic products. Macrobian sells topical cosmetic skincare products, including serums formulated with cosmetic ingredients such as copper peptide (Copper Tripeptide-1, "GHK-Cu"). Our products are cosmetics intended to be applied topically to improve the appearance of the skin. They are not drugs.

No medical or therapeutic claims. Our products are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition, and are not intended to affect the structure or function of the body in any way that would classify them as a drug. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulatory authority. Individual results may vary.

Use responsibly. You are responsible for reading the product label, ingredient list, and directions before use, and for performing a patch test if you have sensitive skin or known allergies. Discontinue use and consult a healthcare professional if you experience irritation or an adverse reaction. If you are pregnant, nursing, have a medical condition, or are taking medication, consult a qualified healthcare professional before using any new skincare product.

3. Digital products and informational materials

We may offer digital products, such as informational guides or reference materials (collectively, "Digital Products").

Educational purpose only. Digital Products and any consultations are provided for general educational and informational purposes only. They do not constitute, and are not a substitute for, professional medical, healthcare, pharmaceutical, legal, or other professional advice. Nothing in our Digital Products or consultations is intended to diagnose, treat, cure, or prevent any condition, to recommend or prescribe any drug, treatment, or dosing protocol, or to direct you to obtain or use any prescription or controlled substance. You should consult a qualified, licensed professional before acting on any information you receive from us.

No professional relationship. Purchasing a Digital Product or consultation does not create a doctor-patient, pharmacist-patient, or other professional relationship between you and Macrobian. You are solely responsible for any decisions you make and any actions you take.

License. When you purchase a Digital Product, we grant you a limited, non-exclusive, non-transferable license to access and use it for your own personal, non-commercial use. You may not copy, resell, redistribute, publish, or share it without our written permission.

4. Consultations

If we offer a consultation, it is a general educational discussion about skincare and our products. It is not a medical appointment, does not involve diagnosis or treatment, and does not result in any prescription, medical recommendation, or treatment plan. Consultations are booked through a third-party scheduling provider, and your use of that provider is subject to its own terms.

5. Orders, pricing, and payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order, including if we suspect fraud, an error in pricing or product information, or a violation of these Terms. If we cancel an order you have paid for, we will issue a refund.

Payments are processed by our third-party payment processor, Stripe. By submitting a payment, you agree to Stripe's applicable terms and authorize us and Stripe to charge your selected payment method for the total amount of your order, including any applicable taxes and shipping. You represent that you are authorized to use the payment method you provide.

6. Shipping and delivery

We ship physical products to the address you provide at checkout. You are responsible for providing an accurate shipping address. Title and risk of loss for physical products pass to you upon our delivery to the carrier. Delivery times are estimates and not guaranteed. Digital Products are delivered electronically; access details are provided after your purchase is confirmed.

7. Returns and refunds

Physical products. Because our products are personal-care items, we accept returns only for products that are unopened and unused, or that arrive damaged or defective. To request a return or report a problem, contact us at contact@macrobian.science within 14 days of delivery. Approved refunds are issued to the original payment method. We may decline returns of opened or used products for health and safety reasons, except where required by law.

Digital products. Because Digital Products are delivered electronically and cannot be returned, all sales of Digital Products are final and non-refundable once access has been provided, except where required by law or where the product is defective or inaccessible.

Consultations. Booked consultations may be rescheduled or canceled in accordance with the notice requirements communicated at the time of booking.

If you have any problem with an order, please contact us first — we want to resolve issues directly and fairly before you pursue a chargeback.

8. Acceptable use

You agree not to use the Site to: violate any law or regulation; infringe our or anyone else's intellectual property or other rights; transmit malware or attempt to gain unauthorized access to the Site or its systems; scrape, harvest, or misuse data; or resell our products or Digital Products without authorization.

9. Intellectual property

The Site and its contents — including text, graphics, logos, the Macrobian name and branding, product formulations, and Digital Products — are owned by or licensed to Macrobian and are protected by intellectual-property laws. We grant you a limited license to access and use the Site for its intended purpose. You may not reproduce, distribute, or create derivative works from our content without our written permission.

10. Disclaimers

The Site, products, Digital Products, and consultations are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information provided is complete, accurate, or current. Any reliance on the Site, our products, or our materials is at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, Macrobian and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site, products, Digital Products, or consultations, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or your purchase will not exceed the amount you paid to us for the product or service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Macrobian and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your purchase or use of our products or Digital Products, or your violation of these Terms or any law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be resolved in the state or federal courts located in Minnesota, and you consent to the jurisdiction of those courts, except where applicable law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
